GTC

  1. Applicability
    The General Terms and Conditions (GTC) apply to all fee-based or free services and products (hereinafter jointly referred to as "services") offered by Pradaschier Top AG (hereinafter referred to as "Pradaschier") via the website pradaschier.ch and at physical points of sale, counters, stores, etc.
    By using one of these services, the customer accepts these GTC for himself and any participants.
    In addition, special provisions may apply to the use of certain services. These are regulated in the corresponding contracts (e.g. contracts for rental items or goods transportation) and take precedence over any provisions in these GTC.
    In addition, the special terms of use for pradaschier.ch also apply (see below to these GTC), which contain specific regulations for visits and bookings via the website. With regard to the website, the special terms of use take precedence over the GTC.
  2. Conclusion of contract
    In the case of written bookings, bookings via the internet, fax, SMS or other electronic means of communication, acceptance of the booking is expressly confirmed to the customer. These confirmations, together with any brochures with service descriptions and the fee to be paid, form the contract. The contract shall only come into effect upon delivery of the confirmation by Pradaschier. The written confirmation can also be sent electronically. If services are ordered verbally at the points of sale provided for this purpose, the contract is concluded upon unconditional acceptance of the order by Pradaschier.
    Pradaschier sells its services directly and via intermediaries/partners. If a product is purchased via an agent/partner, the contract is concluded with the agent/partner.
    The special provisions on third-party services (section 8) remain reserved.
    The relevant provisions of the special terms of use for pradaschier.ch apply to the conclusion of contracts for bookings on pradaschier.ch.
    Information on services and prices
    Services
    The services are defined in the corresponding offer descriptions.
    All information (in particular on the scope of services) is without guarantee. Arosa Lenzerheide Pradaschier reserves the right to change service descriptions in brochures and on the Internet at any time and without prior notice.
    Prices and terms of payment
    Unless otherwise stated, prices are inclusive of VAT and in Swiss francs (CHF).
    If foreign currencies are accepted, the fixed daily exchange rate applies. Change is made in Swiss francs (CHF).
    Pradaschier reserves the right to change prices quoted in brochures and on the Internet at any time and without prior notice. In particular, Pradaschier reserves the right to change prices in the event of

introduction or increase of fees, charges and taxes as well as transportation costs after conclusion of the contract.
Pradaschier specifies the terms of payment in the service descriptions. In the absence of such a specification, the payment deadline according to Pradaschier's invoice applies. If payment is not made on time, Pradaschier is entitled to refuse the service to be provided.

The special terms of payment in connection with third-party services (clause 8.3) remain reserved.
Disruption to the performance of the contract
Pradaschier is entitled to change the agreed service or offer a replacement if there are important reasons for doing so.
If the performance of the contract by Pradaschier is rendered impossible or impaired due to force majeure, Pradaschier is entitled to withdraw from the contract - with reimbursement of the services not received. There is no entitlement to compensation.
Liability
Pradaschier is liable to the customer for the proper provision of the service. Liability is excluded if the non-performance or incorrect performance is due to omissions or to the conduct of the Customer or a third party who is not involved in the provision of the service, or to force majeure or events that cannot be foreseen or averted. Liability for slight negligence is excluded.
If Pradaschier has reasonable grounds to believe that an event for which property belonging to Arosa Lenzerheide is being used jeopardizes the smooth running of the business, the safety or the reputation of Pradaschier, they are entitled to terminate the reservation agreements at any time without compensation.
Any liability for theft in the area or for damage to property by third parties is excluded.
Pradaschier recommends taking out supplementary insurance cover, e.g. cancellation insurance, travel accident and travel health insurance, return travel expenses insurance.
In the case of third-party services, only the respective contractual partner is liable. Joint and several liability, which would include Pradaschier, is excluded unless explicitly agreed.
In the case of rented storage depots, no liability can be accepted for lost items and valuables.
In the case of goods transportation, goods must be packed by the customer in such a way that they meet the usual standards (Euro pallet). Fragile goods must be packed in such a way that no damage can occur during transportation (recommendation: transport case Pradaschier accepts no liability if the specifications are not adhered to. The instructions of the railroad or supervisory staff must be followed.
The special liability provisions in connection with the sale and use of lift tickets and facilities (section 6.7) and the special liability provisions in connection with third-party services (section 7.8) remain reserved.

Verkauf und Nutzung von Lifttickets und Anlagen
Beförderungsbestimmungen
Mit dem Verkauf eines Lifttickets verpflichtet sich Pradaschier zur Beförderung des rechtmässigen Ticketinhabers oder seines Materials. Inbegriffen ist die Benutzung sämtlicher präparierter und markierter Pisten sowie der Wander-, Bike- und Schlittelwege. Sportgeräte werden nur dann transportiert, wenn die infrastrukturellen und sicherheitstechnischen Einrichtungen dies zulassen und die Schutzbestimmungen über Wildschutz- und Wildruhezonen nicht verletzt werden. Für Wege und Pisten können von Pradaschier und/oder den Behörden Nutzungseinschränkungen gemacht werden. Es gelten die publizierten Transportbestimmungen sowie Anweisungen des Bahnpersonals.
Aus Sicherheitsgründen werden keine Personen mit Kindern in Huckepack, Rucksäcken, anderen Tragevorrichtungen oder auf Schultern auf den Skiliften sowie Sesselbahnen befördert. Ebenso ist in diesem Fall die Nutzung der Ski- und Schlittelpisten nicht erlaubt.
Einschränkung der Nutzung
Kann Pradaschier ihre Pflichten im Zusammenhang mit dem Verkauf und der Nutzung von Lifttickets und Anlagen infolge von Umständen, welche sie nicht abzuwenden vermögen, nicht oder vorübergehend oder teilweise nicht erbringen, entstehen dem Kunden keinerlei Ansprüche gegenüber Pradaschier. Dies gilt insbesondere in folgenden Fällen:
Betriebseinstellungen, Pisten- und Wegsperrungen infolge Zufalls, höherer Gewalt wie Wind- und Wettereinflüsse, Stromausfall, Lawinengefahr, Streiks oder behördliche Anordnungen
Überlastung der Transportanlagen oder Überfüllung der Pisten und Wege sowie daraus resultierende mögliche Wartezeiten
Unterbrüche sowie temporäre Betriebseinstellungen von Teilen der Transportanlagen in Folge Bau- oder Wartungsarbeiten sowie zur Behebung von Störungen.
Im Rahmen der Durchführung von öffentlichen Veranstaltungen kann der Zutritt zu einzelnen Anlagen nicht möglich oder an den Kauf eines Tickets der Veranstaltung gebunden sein. Ferner kann der Zutritt zu Pisten und Wegen gesperrt werden.
Pradaschier kann aufgrund der Nachfrage, behördlicher Vorgaben oder der Witterungsbedingungen das Angebot anpassen.
Nutzungsbestimmungen
Pradaschier legt die Bestimmungen für die Nutzung fest. Der Kunde ist verpflichtet, sich an die publizierten Anweisungen zu halten. Dies sind insbesondere:

Sperrungen von Pisten und Wegen
Markierungen, Warntafeln und Anweisungen zur Nutzung der Bahnen
FIS-Regeln
Regeln zur Trail-Toleranz Ferner wird rücksichtsloses Verhalten oder Trunkenheit/Drogenmissbrauch nicht toleriert.
Anlagen und Einrichtungen von Pradaschier dürfen nicht beschädigt oder verunreinigt werden. Allfällige Instandstellungs-/Reinigungskosten sind durch den Verursacher zu bezahlen.
Bei Verstössen gegen die Nutzungsbestimmungen kann Arosa Lenzerheide den Kunden entschädigungslos vorübergehend oder für immer von der Nutzung ausschliessen.
Im Falle einer vorsätzlichen Beschädigung oder bei konkreter Gefährdung anderer Menschen sowie beim Tatbestand der Störung des öffentlichen Verkehrs (Art. 237 StGB) sind die Bergbahnen berechtigt eine Strafanzeige zu machen.
6.4 Gültigkeit im öffentlichen Verkehr
Pradaschier publiziert die Bestimmungen in Bezug auf die Nutzung des Öffentlichen Verkehrs im Zusammenhang mit einem Liftticket. Für die Gültigkeit im öffentlichen Verkehr muss ein entsprechender Vermerk auf dem Ticket/der Bestätigung vorhanden und die publizierten Bestimmungen eingehalten sein.
6.5 Kosten für Rettungseinsätze
Erleidet ein Kunde einen Unfall bei Benützung der Bahnanlagen und der präparierten und kontrollierten Pisten im Schneesportgebiet Pradaschier kann er den Rettungsdienst der Bergbahnen in Anspruch nehmen. Die Inanspruchnahme des Rettungsdienstes wird mit definierten Fallpauschalen zwischen CHF 100 und CHF 500 zuzüglich Personalleistungen und Materialaufwand verrechnet. Für den Krankenwagentransport werden die effektiven externen Kosten zusätzlich in Rechnung gestellt. Andere Kosten Dritter (z.B. Helikoptertransport, Arztbesuche, Ambulanz) sind direkt durch den Kunden zu vergüten. Es ist Sache des Kunden, allfällige Rückerstattungsansprüche gegenüber seiner Versicherung geltend zu machen. Ein Unfall, für welchen Haftungsansprüche an Pradaschier gestellt werden, ist unverzüglich der betreffenden Betriebsleitung oder am Informationsschalter der Bahnen zu melden, um genaue Angaben zum Hergang der Vorkommnisse zu machen.
Variantenfahren / Wild- und Waldschutzzonen
Für Varianten-, Ski- und Snowboardfahrer bestehen abseits der markierten und kontrollierten Pisten erhöhte Gefahren. Wer Spuren in gefährlichen Hängen hinlegt, verleitet andere, unerfahrene Fahrer zum Nachahmen, was bei geänderten Witterungs- und Schneeverhältnissen zu Lawinen führen kann. Die Pisten der Bergbahnen sind im freien Gelände angelegt. Kleine Waldparzellen gelten als geschützte Wald- und Wildschutzzonen und werden umfahren. Bäume und Sträucher sollen nicht beschädigt und das Wild nicht beunruhigt oder aus seinen Einständen vertrieben werden. Die Wald- und Wildschutzzonen sind entsprechend markiert. Der Kunde wird ausdrücklich aufgefordert, die Hinweistafeln der Bergbahnen zu beachten.
Das Befahren von gesperrten oder markierten Wald- und Wildschutzzonen kann den Entzug der persönlichen Fahrkarte bis hin zur Verzeigung bei den zuständigen Stellen mit sich bringen.
Beanstandungen / Haftung
Allfällige Beanstandungen des Kunden, welche die Leistungserbringung durch Arosa Lenzerheide Pradaschier gemäss dieser Ziff. 7 betreffen, sind unverzüglich an die Bergbahn bzw. an ihre Mitarbeitenden zu richten. Unterbleibt eine sofortige Meldung, gehen dem Kunden allfällige Ansprüche gegenüber den Bergbahnen verloren.
Die Bergbahnen haften für Personen- und Sachschäden, welche durch sie bzw. ihre Mitarbeitenden verursacht werden, nach Massgabe der nachfolgenden Bestimmungen. Subsidiär gelten die einschlägigen Bestimmungen des schweizerischen Obligationenrechts. Eine Haftung ist, soweit gesetzlich zulässig, auf grobfahrlässiges und vorsätzliches Verhalten beschränkt.
Eine Haftung der Bergbahnen für Sach- und Personenschäden ist namentlich ausgeschlossen bei Unfällen infolge
Nichtbeachtens von Hinweisen und Markierungen sowie Verlassen der gesicherten und kontrollierten Pisten
Missachtens von Weisungen und Warnungen der Bahnmitarbeitenden oder des Pisten- und Rettungsdienstes
Missachtung der Warnungen vor Lawinengefahren
fahrlässigem oder vorsätzlichem Verhalten auf Anlagen, Pisten und Wegen
Ausübung von Risiko-Sportarten wie Freeriding, Downhill- und Enduro- Biking, Gleitschirmfliegen etc.
Im Übrigen stützt sich die Haftung der Bergbahnen im Wesentlichen auf die Richtlinien der Verkehrssicherungspflicht für Schneesportabfahrten. Die Bergbahnen haften nicht für Unfälle ausserhalb der gesicherten und markierten Skipisten. Ferner ist jede Haftung für Unfälle auf Bike-, Wander- und Schlittelwegen ausgeschlossen.
Im Rahmen des Unterhalts der Transportanlagen werden Schmiermittel verwendet und durch den Betrieb kann Abrieb bei Führungsrollen entstehen. Je nach Witterung kann dies zu leichten Verschmutzungen von Kleidern führen. Die Bergbahnen haften, soweit gesetzlich zulässig, nur im Fall von unsachgemässer Anwendung von Schmiermitteln. Dabei ist die Haftung höchstens im Rahmen des Wertes gemäss Zeitwerttabelle für die Lebenserwartung von Wintersport-Bekleidung (max. 4 Jahre) gegeben.
Für Personen- oder Sachschäden, welche die Folge der Nichterfüllung oder nicht gehörigen Erfüllung des Vertrages sind, haften die Bergbahnen im Rahmen dieser AGB sowie der massgebenden nationalen Gesetze.
Nutzung der Lifttickets
Mit Ausnahme von besonderen Bestimmungen in den Prospekten und Publikationen sind Lifttickets persönlich und nicht übertragbar. Arosa Lenzerheide legen fest, für welche Tickets ein Name und/oder Foto erfasst werden muss.
Lautet ein Liftticket auf einen oder mehrere bestimmte Tage, kann es nicht auf andere Tage übertragen werden. Für nicht genutzte Tage besteht kein Anrecht auf eine Rückerstattung.
Lifttickets, bei denen der Kunde innerhalb einer bestimmten Zeitperiode selber über die Nutzung entscheidet (Tageswahlkarten), können weder verlängert noch rückerstattet werden.
Rückerstattungen
Allgemeines
Anrecht auf eine anteilmässige Rückerstattung besteht ausschliesslich gegen Vorweisung eines ärztlichen Zeugnisses und läuft mit dem Ende der jeweiligen Saison ab. Wurde das Liftticket in der Periode der ärztlichen Bestätigung benutzt, verfällt der Anspruch auf eine Rückerstattung.
Bei Verbund-Abonnementen mit anderen Gebieten gehen die Bestimmung für die jeweilige Karte den Bestimmungen dieser AGB vor.
Jahreskarten
Die Rückerstattung erfolgt anteilig ab dem Datum, seitdem die Karte nicht mehr genutzt werden konnte:

For family tickets, the proportionate discount compared to the individual purchase is deducted before the refund is calculated.
The medical certificate (incapacity for sport/illness) must cover at least 30 days of operation for an annual pass.
Official closure due to a pandemic
In the event of an official order to close the entire ski area due to a pandemic, the mountain railroads will grant the following refund for the annual passes sold by them:
Price paid x days lost
260 days of operation
The closure must affect the entire area of validity of a subscription. The lost days are deemed to be the result of the order if the number of operating days falls below 260. Days lost as a result of the purchase date are not included in the calculation. The refund will be issued in the form of an offset against the purchase of the next season ticket or as a credit note.
6.9.4 Lift tickets issued for one or certain days
The proportion of days that could not be used in relation to the total number of days purchased is decisive for the refund.
6.10 Loss of lift ticket
If lost multi-day tickets can no longer be found, they will be replaced on presentation of the purchase receipt (blocking number voucher).
Keycard deposit fee
Lift tickets are issued on a keycard or other compatible data carrier. A deposit of CHF 5.00 will be charged when a keycard is handed in, which will be refunded when it is returned. Defective keycards will be replaced free of charge, provided that no damage has been caused by the customer.
Misuse / ID requirement
The employees of the mountain railroads and authorized control personnel are entitled to carry out ticket checks at any time. Upon request, the ticket holder must identify himself/herself by means of a valid identity card or an equivalent form of identification. Identification for a specific discount (e.g. disability card) must be presented at all times.
If ticket misuse is detected, such as the use of tickets by/for third parties or forgery/passing on of tickets, this will result in the immediate withdrawal of the ticket. At the same time, a circulation fee of CHF 250.00 will be charged.
In the event of a repeat offense, the ticket will be confiscated and criminal charges will be brought.
Data protection
The collection and processing of customers' personal data by the mountain railroads is explained in the data protection declaration on pradaschier.ch. This forms an integral part of the GTC.
Severability clause
The invalidity or ineffectiveness of individual provisions of these GTC in whole or in part shall not affect the validity of the remaining provisions or parts of such provisions.
Invalid or ineffective provisions shall be replaced by provisions that correspond as closely as possible to their legal or economic meaning. The same procedure is to be followed if there is a loophole in these GTC.
Applicable law and place of jurisdiction
Swiss law is exclusively applicable to all legal relationships between the customer and the mountain railroads and between the customer and the service provider.
The exclusive place of jurisdiction for disputes arising from or in connection with legal relationships between the customer and Pradaschier is Chur, Switzerland.
The exclusive place of jurisdiction for disputes arising from or in connection with a contract between the customer and the service provider is the (residential) domicile of the service provider.

Special terms of use for pradaschier.ch
(Online T&Cs)

  1. Scope of application
    Unless expressly stated otherwise below, the same abbreviations and definitions are used for the Online T&Cs as in the GTCs.
    The website www.pradaschier.ch (hereinafter referred to as the "Website") is operated by Pradaschier Top AG. These Online T&Cs shall apply in the version current at the time of conclusion of the contract to all business relationships between the user of the Website and Pradaschier in connection with the use of the Website and bookings of services via the Website. They form an integral and supplementary part of all bookings made via the website.
    In addition to or together with these Online T&Cs, Pradaschier's T&Cs also apply to bookings made via the website, which are applicable to all contractual relationships irrespective of the sales channel. The GTC, in particular section 8, are relevant if lift tickets or third-party services are booked via the website. The following Online T&Cs contain exclusively website-specific provisions.
    Pradaschier may amend these Online T&Cs at any time. The version in force at the time of the visit or booking shall be decisive.
    Any other contractual terms and conditions, in particular those which the customer declares to be applicable together with the acceptance of the contract, shall only be valid if and insofar as they have been expressly accepted by Pradaschier in writing.
    Offers
    The presentations and information on the website are non-binding. Pradaschier reserves the right to modify the services and their presentation and description at any time and to remove certain services completely from the website. Pradaschier excludes all liability for typographical errors, incorrect or incomplete information and representations.
    Pradaschier endeavors to ensure the best possible availability of the services offered on the website. However, the presentation of a particular service on the website does not mean that Pradaschier provides a guarantee of availability. This applies in particular, but not exclusively, to third-party services which are offered by service providers and for which Pradaschier is not responsible (see Section 8 of the GTC).

Conclusion of contract
If the Customer makes a booking via the website, he is making a binding offer to conclude a contract with Pradaschier or, in the case of third-party services, with the relevant service providers (Section 8).
A binding order is only triggered when the Customer has entered all the data required to execute the contract, confirmed that he has read the GTC and these online GTC and clicked on the "Order" button.
After submitting the booking, the Customer receives an automatically generated confirmation of receipt of his booking by email. This contains the details of the booking. The confirmation of receipt does not constitute a contract; the confirmation of receipt merely documents that the booking has been received by Pradaschier.
The contract is concluded when Pradaschier declares acceptance of the contract. Pradaschier declare acceptance of the contract by confirming the booking to the customer (booking confirmation).
The contract is only concluded for those services that are expressly listed in the confirmation. This also conclusively defines the scope of services.

  1. Payment
    If there are no special payment conditions for individual offers and services - about which the customer is explicitly informed during the booking process - the provisions in the GTC apply.
    Discounts or vouchers are only accepted subject to the conditions displayed on the voucher. A voucher code or value is entered during the payment process. Discounts not claimed during this process can no longer be granted retrospectively. Discounts cannot be accumulated.
  2. Retention of title
    Pradaschier retains title to the delivered goods in all cases until the respective invoice amount of a delivery has been paid in full (final and unconditional crediting of the total purchase price). In the case of customers domiciled in Switzerland, Pradaschier is entitled to make a corresponding entry in the retention of title register. If the customer is an entrepreneur exercising a commercial or independent professional activity, a legal entity under public law or a special fund under public law, Pradaschier retains ownership of the purchased goods until all outstanding claims arising from the business relationship with the customer have been settled. The corresponding security rights are transferable to third parties. The customer is only entitled to a right of set-off if his counterclaims have been legally established, are undisputed by Pradaschier or are ready for a decision. Furthermore, the customer only has a right of retention if and insofar as his counterclaim is based on the same contractual relationship. In the event of defects in the delivery, the customer's counter-rights remain unaffected in particular.
    Assignment
    Arosa Lenzerheide reserves the right to assign or pledge its claims or, in the case of third-party services, the claims of the service providers against the customer, including any instalments due, default interest and reminder fees, to third parties.
    Liability
    Liability for slight negligence and liability for auxiliary persons is excluded in full, to the extent permitted by law. Furthermore, the statutory liability provisions apply.
    Pradaschier accepts no liability for internet errors, damage caused by third parties, imported data of any kind (viruses, worms, Trojan horses) or for links to and from other websites.
    No liability is accepted for any direct, indirect, special or other consequential damages arising out of the use of the www.pradaschier.ch website or any website linked to it. Also excluded is any liability for loss of profit, business interruption, loss of programs or other data in your information systems.
    This also applies if the possibility of such damages is expressly indicated.
    Furthermore, all cases of breach of contract and their legal consequences as well as all claims of users and customers, irrespective of the legal grounds on which they are based, are conclusively regulated in the GTC or these online GTC.
  3. Data protection
    The collection and processing of the personal data of users and customers on the website by the mountain railroads is explained in the data protection declaration. This forms an integral part of the GTC and Online GTC. The privacy policy is available at: www.pradaschier.ch.
    Users and customers consent to the storage of the personal data they enter when using the website for the purpose of processing the contract. They also consent to the use of personal data for the personalization of advertisements and product offers placed on the website.
    Users and customers also acknowledge and agree that Pradaschier is jointly responsible for the collection and processing of personal data and that they all therefore have access to this data. The users also agree that the personal data which the users and customers transmit to the mountain railroads via the website, e.g. when making a booking or contact request, will be stored by Pradaschier in a central database. Pradaschier is entitled to analyze and evaluate the data in the central database in order to send personalized marketing communications to users and customers, e.g. information about new offers in which the users and customers concerned may be interested. These analyses may result in user profiles.
    Pradaschier only uses the data in the cases permitted by law (e.g. for mail advertising or for target group-specific online advertisements). Insofar as Pradaschier uses data for a purpose that requires the consent of the user or customer in accordance with the statutory provisions, Pradaschier will obtain consent in each case. Customers or users can revoke the consent they have given at any time and/or object to future use of the data.
    In the case of third-party services, Pradaschier also obtains the booking data on behalf of the service providers and will forward this to the service providers for booking processing. The service providers may also use the data for other purposes. Users and customers are therefore requested to take note of the data protection declarations of the service providers. If the data is collected for a specific purpose (e.g. newsletter for an event organized by a third party), the data may be passed on in accordance with the purpose.

The use of this website does not imply that the user is granted any license rights with regard to the intellectual property rights to the content of this website.
This website and all content posted on it (in particular software, files, designs, graphics and data) are and remain the property of Pradaschier - or Pradaschier holds corresponding rights of use - and are protected by the relevant laws regarding intellectual property rights, including copyright and trademark protection rights. Any unauthorized use of this website, in particular the use of this website or its contents for professional or commercial purposes of any kind as well as the reproduction, display, transmission to others, communication, circulation, distribution, modification, licensing, sale or any other exploitation of this website or its contents, texts, parts of texts, static or animated graphics, audio data, software, goods or services as well as other data or information, is expressly prohibited without the prior written consent of Pradaschier. In particular, methods such as framing and inlinelinking of the website and its content are prohibited.
Applicable law and place of jurisdiction
