1. Applicability

These Terms and Conditions apply to all paid and free services and products (hereinafter collectively referred to as “Services”) offered by Pradaschier AG Top via the website pradaschier.ch as well as at physical retail locations, counters, stores, etc.

By using any of these services, the customer agrees to these Terms and Conditions on behalf of themselves and any participants.

In addition, specific terms and conditions may apply when using certain services. These are set forth in the relevant contracts (e.g., contracts for rental items or the transport of goods) and take precedence over any provisions in these Terms and Conditions. 

In addition, the Special Terms of Use for pradaschier.ch also apply (see below these Terms and Conditions), which contain specific provisions regarding visits to and bookings made through the website. With regard to the website, the Special Terms of Use take precedence over these Terms and Conditions. 

2. Conclusion of the Contract 

For bookings made in writing, via the Internet, by fax, text message, or other electronic means of communication, the customer will receive explicit confirmation of the booking’s acceptance. These confirmations, together with any brochures containing service descriptions and the applicable fees, constitute the contract. The contract is concluded only upon delivery of the confirmation by Pradaschier AG Top. The written confirmation may also be provided electronically. If services are ordered verbally at the designated sales outlets, the contract is concluded upon Pradaschier AG Top’s unconditional acceptance of the order. 

Pradaschier AG Top sells its services directly and through intermediaries/partners. If a product is purchased through an intermediary/partner, the contract is concluded with that party.

The special provisions regarding third-party services (Section 8) remain in effect. 

The relevant provisions of the Special Terms of Use for pradaschier.ch apply to the conclusion of contracts for bookings made on pradaschier.ch.

3. Information on Services and Prices

3.1 Services 

The services are defined in the relevant proposal descriptions. 

All information (particularly regarding the scope of services) is provided without warranty. Pradaschier AG Top reserves the right to change service descriptions in brochures and on the Internet at any time and without prior notice.

3.2 Prices and Payment Terms   

Unless otherwise noted, prices include value-added tax and are listed in Swiss francs (CHF). 

When accepting foreign currencies, the daily exchange rate set by Pradaschier AG Top applies.

Change is given in Swiss francs (CHF). 

Pradaschier AG Top reserves the right to change the prices listed in brochures and on the Internet at any time and without prior notice. In particular, Pradaschier AG Top reserves the right to increase prices in the event of the introduction or increase of fees, duties, taxes, or shipping costs after the contract has been concluded. 

Pradaschier AG Top specifies the terms of payment in the scope of services. If no such information is provided, the payment term shall be as stated on the invoice issued by Pradaschier AG Top. In the event of late payment, Pradaschier AG Top is entitled to refuse to perform the service.

The special payment terms relating to third-party services (Section 8.3) remain in effect.

4. Disruption of Contract Performance

Pradaschier AG Top is entitled to modify the agreed service or offer a substitute if there are compelling reasons to do so. 

If Pradaschier AG Top is unable to perform the contract or if performance is impaired due to force majeure, the customer is entitled to withdraw from the contract, provided that the cost of any services not yet received is refunded. There is no entitlement to damages.

5. Liability

Pradaschier AG Top is liable to the customer for the proper performance of the service. Liability is excluded if the non-performance or improper performance is attributable to omissions or the conduct of the customer or a third party not involved in the provision of the service, or to force majeure or events that are unforeseeable or unavoidable. Liability for slight negligence is excluded. 

Pradaschier AG Top recommends obtaining additional insurance coverage, such as trip cancellation insurance, travel accident and medical insurance, and return travel insurance. 

In the case of third-party services, only the respective contractual partner is liable. Joint and several liability involving Pradaschier AG Top is excluded, unless explicitly agreed upon.

We cannot accept liability for lost items or valuables in rented storage lockers. 

The specific liability provisions regarding the sale and use of lift tickets and facilities (Section 6.7) and the specific liability provisions regarding third-party services (Section 7.8) remain in full force and effect. 

6. Sale and Use of Lift Tickets and Facilities 

6.1 Terms and Conditions of Carriage  

By purchasing a ticket, Pradaschier AG Top agrees to transport the legitimate ticket holder or their equipment. This includes the use of all groomed and marked slopes, as well as hiking and sledding trails. Sports equipment will only be transported if the infrastructure and safety facilities permit it and if regulations regarding wildlife protection and wildlife quiet zones are not violated. Pradaschier AG Top and/or the authorities may impose restrictions on the use of trails and slopes. The published transportation regulations and instructions from the lift staff apply.

For safety reasons, no one is permitted to use the facilities while carrying children on their backs, in backpacks, in other carrying devices, or on their shoulders. In such cases, use of the ski and sledding slopes is also prohibited. 

6.2 Restrictions on Use

If Pradaschier AG Top is unable to fulfill its obligations regarding the sale and use of tickets and facilities—either temporarily or in part—due to circumstances beyond its control, the customer shall have no claims against Pradaschier AG Top. This applies in particular to the following cases:

  • Operational changes, slope and trail closures due to unforeseen circumstances, force majeure such as wind and weather conditions, power outages, avalanche danger, strikes, or official orders
  • Overcrowding of facilities or congestion on the slopes and trails, as well as the resulting potential wait times
  • Interruptions and temporary shutdowns of parts of the facilities due to construction or maintenance work, as well as to resolve malfunctions.

Pradaschier AG Top reserves the right to adjust its offerings based on demand, regulatory requirements, or weather conditions.

6.3 Terms of Use for  

Pradaschier AG Top sets forth the terms of use. The customer is required to comply with the published instructions. These include, in particular: 

  • Staff Assignments
  • Closures of ski runs and trails
  • Signs, warning signs, and instructions/access requirements for using the facilities
  • FIS Rules

Furthermore, reckless behavior or drunkenness/drug abuse will not be tolerated.

Equipment and facilities belonging to Pradaschier AG Top must not be damaged or soiled. Any repair or cleaning costs must be paid by the person responsible. 

In the event of a violation of the Terms of Use, Pradaschier AG Top may suspend or permanently ban the customer from using the service without compensation.

In the event of intentional damage, a concrete threat to the safety of others, or the offense of disrupting public transportation (Art. 237 of the Swiss Criminal Code), the mountain railways are entitled to file a criminal complaint.

6.4 Validity on public transportation  

Pradaschier AG Top publishes the terms and conditions governing the use of public transportation in connection with a lift ticket. For the ticket to be valid on public transportation, it must bear a corresponding notation, and the published terms and conditions must be followed.

6.5 Costs of rescue operations

If a customer is involved in an accident while using the facilities and the groomed and inspected slopes within the Pradaschier AG Top area, they may call upon the mountain railway rescue service. Use of the rescue service is billed at fixed rates ranging from CHF 100 to CHF 500. For ambulance transport, the actual external costs will be billed additionally. Other third-party costs (e.g., helicopter transport, doctor’s visits, ambulance) must be paid directly by the customer. It is the customer’s responsibility to assert any claims for reimbursement against their insurance provider. Any accident for which liability claims are made against Pradaschier AG Top must be reported immediately to the relevant operations management or at the cable car ticket office in order to provide detailed information regarding the circumstances of the incident.

6.6 Off-piste skiing / Wildlife and forest protection zones

Off-piste skiers, snowboarders, and freeriders face increased dangers away from marked and patrolled slopes. Anyone who leaves tracks on dangerous slopes encourages other, inexperienced riders to follow suit, which can lead to avalanches if weather and snow conditions change. The ski runs of the mountain railways are located in open terrain. Small forest plots are designated as protected forest and wildlife zones and must be bypassed. Trees and shrubs must not be damaged, and wildlife must not be disturbed or driven from its habitats. The forest and wildlife zones are marked accordingly. Customers are expressly requested to observe the mountain railway’s information signs. Entering closed or marked forest and wildlife protection zones may result in the revocation of your personal ticket or even a report to the relevant authorities.

6.7 Complaints / Liability

Any complaints by the customer regarding the services provided by Pradaschier AG Top in accordance with this Section 7 must be reported immediately to the mountain railway or its staff. Failure to report such issues immediately will result in the customer forfeiting any claims against the mountain railway. 

The mountain railways are liable for personal injury and property damage caused by them or their employees in accordance with the following provisions. In the absence of such provisions, the relevant provisions of the Swiss Code of Obligations apply. To the extent permitted by law, liability is limited to gross negligence and intentional conduct. 

The mountain railways shall not be liable for property damage or personal injury, in particular in the event of accidents resulting from

  • Failure to follow signs and markings, as well as leaving the secured and monitored slopes
  • Failure to comply with instructions and warnings from railway staff or the piste and rescue services 
  • Failure to heed warnings about avalanche danger
  • negligent or intentional conduct on facilities, slopes, and trails
  • Participation in high-risk sports such as: freeriding, downhill and enduro biking, paragliding, etc.

Furthermore, the liability of the mountain railways is based primarily on the guidelines governing the duty to ensure safety on snow sports slopes. The mountain railways are not liable for accidents occurring outside of secured and marked ski slopes. In addition, any liability for accidents on hiking and sledding trails is excluded.

Lubricants are used as part of the maintenance of the transport facilities, and their operation can cause wear on the guide rollers. Depending on weather conditions, this may result in minor soiling of clothing. To the extent permitted by law, the mountain railways are liable only in the event of improper use of lubricants. Liability is limited to a maximum of the value specified in the current value table for the expected lifespan of winter sports clothing (max. 4 years).

The mountain railways shall be liable for personal injury or property damage resulting from non-performance or improper performance of the contract, in accordance with these Terms and Conditions and applicable national laws.

If no proof of purchase or equivalent documentation (e.g., online order confirmation, bank statement) is available, Pradaschier AG Top AG may determine the value at its reasonable discretion. The current market value and standard market prices for identical or equivalent items (including current sale prices) shall be decisive; MSRP/list prices are not decisive. Without appropriate proof, any compensation per item is limited to CHF 300.00. Pradaschier AG Top AG may provide compensation at its discretion through repair, replacement, or a credit note; cash payment is excluded to the extent permitted by law.

6.8 Use of Tickets  

Unless otherwise specified in the brochures and publications, tickets are personal and non-transferable. Pradaschier AG Top determines for which tickets a name and/or photo must be recorded.

If a ticket is valid for one or more specific days, it cannot be transferred to other days. There is no entitlement to a refund for unused days.

6.9 Refunds  

6.9.1 General Information

Entitlement to a pro-rata refund is granted only upon presentation of a medical certificate and expires at the end of the respective season. If the lift ticket was used during the period covered by the medical certificate, the right to a refund is forfeited. 

For combined passes covering other areas, the terms and conditions for the respective pass take precedence over the terms and conditions set forth in these General Terms and Conditions. 

6.9.2 Annual Passes

The refund will be calculated on a pro-rata basis starting from the date the card could no longer be used:

  • Through the end of October 80%
  • By the end of November 70%
  • By the end of December 60%
  • By the end of January 45%
  • Through the end of February 30%
  • Starting in March no refunds will be issued

For family tickets, the prorated discount is deducted from the individual purchase price before the refund is calculated.

For an annual pass, the medical certificate (inability to participate in sports/illness) must cover at least 30 operating days.  

6.9.3 Tickets issued for a specific date or specific dates

The refund amount is based on the proportion of unused days out of the total number of days purchased.

6.9.4 Tickets/multi-ride passes issued for unspecified dates

Tickets for which the customer decides when to use them within a specific time period (e.g., multi-ride tickets, day passes) cannot be extended or refunded.

There is no entitlement to an extension in the event of standard restrictions (e.g., weather conditions, safety concerns, maintenance, official orders, force majeure).

Any extension, exchange, or conversion to an alternative service—if granted at all—is provided solely as a gesture of goodwill. The nature and scope of any goodwill arrangement are at the sole discretion of Pradaschier AG Top, are assessed on a case-by-case basis, and do not constitute a legal entitlement. Furthermore, goodwill granted in the past does not create any entitlement for the future. Mandatory statutory claims remain reserved.

6.10 Loss of the ticket

6.10.1 Tickets issued for specific dates

If lost multi-day passes cannot be found, they will be replaced upon presentation of the purchase receipt (blocking number slip).

6.10.2 Tickets/multi-ride passes issued for unspecified dates

The purchaser is responsible for the safe safekeeping of tickets and multi-ride passes without a fixed date. In the event of loss, theft, misuse, or damage to the ticket, there is generally no entitlement to a replacement, exchange, or refund. If a ticket is personalized or uniquely identifiable (e.g., via booking number/QR code), a replacement—if granted at all—may be provided solely as a gesture of goodwill and following review by Pradaschier AG Top; there is no legal entitlement to such a replacement.

6.11 Keycard Storage Fee  

Lift tickets are issued on a keycard or another compatible medium. A deposit of CHF 5.00 is charged when a keycard is issued, which is refunded upon return. Defective keycards will be replaced free of charge, provided they have not been damaged by the customer.

6.12 Misuse / Obligation to Present Identification  

Mountain railway staff and authorized inspection personnel are authorized to check tickets at any time. Upon request, the ticket holder must present valid identification or an equivalent document. Documents entitling the holder to a specific discount (e.g., a disability card) must be available for presentation at any time.

If any misuse of tickets is detected—such as using tickets issued to or for third parties, or forging or transferring identification documents—this will result in the immediate revocation of the travel pass. At the same time, an administrative fee of CHF 250.00 will be charged.

In the event of a repeat offense, the ticket will be confiscated and criminal charges will be filed.

7. Gift certificates for Pradaschier AG Top

7.1 Sale & Amount

Pradaschier AG Top sells various types of gift cards through the Idea Creation GmbH (E-Guma) online store. The gift cards are available in both physical and print-at-home formats.

The gift certificates can also be given out by Pradaschier AG Top as gifts or as part of a promotional campaign. 

7.2 Validity & Return Policy

Vouchers are valid for 10 years from the date of issue, unless a shorter validity period is specified in the sales materials. Shorter validity periods may also apply if the voucher is provided free of charge as part of a promotion or for other reasons. Vouchers cannot be returned or redeemed for cash. Lost or stolen vouchers will not be replaced.

7.3 Redemption Terms

The vouchers are valid at participating locations. The list of participating locations is subject to change.

7.3.1 Physical Maps

Vouchers in the form of physical cards can be purchased in the online store or at a local retail location. The cards can be redeemed directly at all participating merchants.

8. Offers from Service Providers

8.1 Contractual Relationship

Service providers in the Arosa Lenzerheide vacation region (hereinafter referred to as “Service Providers”) provide, among other things, services related to hotels, vacation apartments, group accommodations, sports shops, and snow sports schools (hereinafter referred to as “Third-Party Services”), which are booked by customers via the website and sales outlets of Pradaschier AG Top. 

Pradaschier AG Top arranges third-party services on behalf of and for the account of the service providers. Contracts for third-party services are concluded exclusively between the respective service providers and the customers.

Pradaschier AG Top is expressly authorized by the service providers to enter into contracts on behalf of the respective service provider and to collect payment for the services booked.

The provisions of Section 2 of the General Terms and Conditions apply to the conclusion of the contract; in the case of online contracts, the special terms of use for www.pradaschier.ch apply. 

If the customer registers additional participants for third-party services, the customer is liable for the participants’ contractual obligations (in particular, payment of the travel price) as well as for his or her own contractual obligations.

The contractual relationship between the customer and the service provider is governed by the provisions of these General Terms and Conditions, in particular the provisions of this Section 9, as well as the specific terms of use for pradaschier.ch, provided that the booking is made via the website. In addition, service providers may establish their own terms of use. The customer will be made aware of such terms of use of the service provider in the service description or, at the latest, during the booking process. In the event of a conflict, these Terms and Conditions, in particular the provisions in this Section 9, as well as the special terms of use for pradaschier.ch, shall take precedence over the service provider’s terms of use. 

8.2 Information about third-party services

The information regarding the various services is compiled by the service providers with the utmost care, and the service providers make every effort to ensure that the information published is up to date. The details provided in the booking confirmation are binding with regard to third-party services. 

Pradaschier AG Top publishes information about various third-party services on behalf of the service providers and is not responsible for the content of such information. The information is provided "as is" and is subject to change at any time without notice. The information regarding the terms and scope of the services does not constitute a binding offer from either the service provider or Pradaschier AG Top. 

8.3 Liability 

If the booked services cannot be provided due to unforeseeable or unavoidable events or force majeure (in particular natural disasters or government measures), the service provider may terminate the contract without liability for damages. Any amounts paid will be refunded in full. Further claims are excluded. The customer may only cancel the contract if the service provider is unable to provide a substitute service in accordance with Section 8.3.

If these circumstances arise during the performance of the contract, the price for the services rendered remains due. Services not rendered will be refunded.

The service provider is responsible to the customer for providing the agreed-upon services in accordance with the contract, as specified in the itinerary and booking confirmation, with all liability excluded to the extent permitted by law. All information (particularly regarding public facilities, such as the availability and opening hours of swimming pools and restaurants, weather conditions, or the availability of transportation) is provided without guarantee.

Pradaschier AG Top is responsible for making the correct booking; however, it assumes no liability for service providers, their agents, sales intermediaries, lost vacation time, and/or consequential damages. Pradaschier AG Top excludes all liability to the extent permitted by law.

9. Privacy Policy

The collection and processing of customers’ personal data by the mountain railways is explained in the privacy policy on pradaschier.ch. This policy forms an integral part of the Terms and Conditions.

10. Severability Clause

The invalidity or unenforceability of any provision of these Terms and Conditions, in whole or in part, shall not affect the validity of the remaining provisions or parts thereof. 

Any invalid or unenforceable provisions shall be replaced by provisions that most closely correspond to their legal or economic intent. The same procedure shall apply if these Terms and Conditions contain any omissions.

11. Governing Law and Jurisdiction

All legal relationships between the customer and the mountain railways, as well as between the customer and the service provider, are governed exclusively by Swiss law.

The exclusive venue for disputes arising out of or in connection with legal relationships between the customer and Pradaschier AG Top is Chur, Switzerland.

The exclusive venue for disputes arising out of or in connection with a contract between the customer and the service provider is the service provider’s place of business or domicile.
